The Last and Final Settlement Scheme is a new scheme being floated by the Haryana Shahari Vikas Pradhikaran in order to safeguard the interests of the allottees by easing the process of recovery and settling their long pending disputes at once. The purpose of the scheme is to realize the dues of additional price (Enhancement) from the defaulting allottee and no refund shall be admissible. The maximum rebate to be given to a defaulting allottee shall be to the extent of the amount shown as outstanding in the enhancement head in the allottees account on HSVP Portal.

The Last and Final Settlement Scheme shall remain open from the date of its launch, i.e. 17.08.2022 to 30.09.2022. All beneficiaries are required to register themselves on the portal and make payment during this period.

• The benefit of the LFSS scheme under the head additional price alongwith interest/delayed interest will be available to those allottees who will clear the entire dues in the PPM System as on the date prior to implementation of LFSS i.e. 31.07.2022 tentatively.
• The scheme shall be applicable to the allottees of residential plots, Group Housing Sites, Industrial & Institutional Sites. However, in cases of the residential plots where floor wise registration has been done, their allottees will not be considered to avail the benefit of the scheme. In such cases of residential plots where floor wise registration has been done, terms and conditions of the scheme will be issued separately.

• The benefit of the scheme will not be available to those allottees who have already availed the benefit of “One Time Settlement Scheme” (OTSS) or “Full and Final Settlement Scheme” (FFSS) and Last and Final Settlement Scheme-2021.

The calculation of additional price shall be done in two parts i.e. before 01.04.2015 (Part-A) and after 01.04.2015 (Part-B).

• In Part-A, no benefit of re-calculation of additional price shall be given.
• In Part-B, benefit of re-calculation of additional price as per Instruction No. 63 dated 22.08.2019 may be permitted with suitable modification.

• If an allottee has made payment before the last date of installment of Part-A then interest in Part-A shall be charged @ 15% till the last date of installment of Part-A.
• If an allottee has made payment after the last date of installment of Part-A, but before the issue of demand of additional price in Part-B then interest in Part-A shall be charged @ 15% till the date of payment. After the date of last payment by the allottee, the interest on outstanding principal amount till the date of launch shall be charged @12%.

Interest in Part-B will be calculated as per the interest table mentioned as under:-

The scheme is voluntary and optional at the instance of an allottee covered under the scheme. However, where the benefit of the scheme has been availed by the allottee, it shall constitute settlement of all the disputes, issues, litigations pertaining to the demand of additional price. The allottee desirous to avail the benefit of this scheme shall have to give an undertaking that he will withdraw the litigation pending in any court of law either individually or through any association or society and he will not dispute the calculations of additional price in future.

In case the allottee does not opt for the benefit of the scheme, the allottee shall be liable to pay the entire outstanding amount towards additional price along with interest/delayed interest thereon as per the original calculations as were existing at the time of demand notice issued to the allottee.

To apply for the scheme, a special portal has been created where a list of eligible beneficiaries has been provided. Those willing to avail the scheme shall be required to register themselves by providing the necessary details about their plots. After successful registration, a comparative report shall be generated which shall provide information about the amount payable before and after the scheme, interest rates, etc. with detailed calculation of the figures arrived at. A pay button shall be displayed from where beneficiaries can make payment and generate receipt of the same.

"लास्ट ऐंड फाइनल सेटलमेंट स्कीम-2022” एक नई योजना है जिसे हरियाणा शहरी विकास प्राधिकरण द्वारा शुरू किया गया है। यह योजना आवंटियों के लिए रिकवरी की प्रक्रिया को आसान बनाने और लंबित विवादों का निपटारा करने के लिए बनाई गई है। इस स्कीम का उद्देश्य डिफॉल्ट करने वाले आवंटियों से अतिरिक्त कीमत (एनहांसमेंट) के बकाए को जमा करवाना है, और कोई रिफंड स्वीकार्य नहीं होगा। जितनी राशि एच.एस.वी.पी. पोर्टल पर आवंटियों के खाते में एन्हांसमेंट हेड में बताई जाएगी, डिफॉल्ट करने वाले आवंटियों को उतनी ही छूट मिलेगी।

लास्ट ऐंड फाइनल सेटलमेंट स्कीम को लॉन्च की तारीख यानि 17 अगस्त, 2022 से लेकर 30 सितंबर, 2022 तक चलाया जाएगा। सभी लाभार्थियों को इस अवधि के दौरान पोर्टल पर खुद को पंजीकृत करके भुगतान करना आवश्यक है।

• एलएफएसएस योजना का लाभ अतिरिक्त मूल्य के साथ ब्याज/ विलंबित ब्याज के तहत उन आवंटियों को उपलब्ध होगा जो एलएफएसएस के कार्यान्वयन से पहले की तारीख यानी 31.07.2022 को अस्थायी रूप से पीपीएम सिस्टम में संपूर्ण बकाया राशि का भुगतान करेंगे।
• यह योजना रेजिडेंषियल प्लाॅट, समूह हाउसिंग साइटस, औद्योगिक और संस्थागत साइटों के आवंटियों पर लागू होगी। हालांकि, रेजिडेंषियल प्लाॅट के मामलो में जहां मंजिलो के हिसाब से पंजीकरण किया गया है, वह आवंटी इस योजना के लिए मान्य नहीं हैं। रेजिडेंषियल प्लाॅट के ऐसे मामलों में जहां मंजिलो के हिसाब से पंजीकरण किया गया है उनके लिए अलग से योजना के नियम और शर्तें जारी की जाएंगी।

• इस योजना का लाभ उन आवंटियों को नहीं मिलेगा जो “वन टाइम सेटलमेंट स्कीम” (OTSS) या “फुल एंड फाइनल सेटलमेंट स्कीम” (FFSS) और “लास्ट एंड फाइनल सेटलमेंट स्कीम(LFSS-2021)” का लाभ उठा चुके हैं।

अतिरिक्त कीमत का हिसाब दो भागों में लगाया जाएगा, पहला भाग होगा 01.04.2015 से पहले (पार्ट-ए) और दूसरा भाग होगा 01.04.2015 के बाद (पार्ट-बी)।

• पार्ट-ए में, अतिरिक्त मूल्य की री-कैलकुलेशन का कोई लाभ नहीं दिया जाएगा।
• पार्ट-बी में, निर्देश संख्या 63, दिनांक 22.08.2019, के अनुसार अतिरिक्त मूल्य की पुनः गणना के लाभ को उचित संशोधन के साथ अनुमति दी जा सकती है।

योजना के तहत ब्याज को निम्नलिखित तरीके से कैलकुलेट किया जाएगा:

पार्ट-ए:

• यदि किसी आवंटी ने पार्ट-ए की अंतिम तिथि से पहले किश्त का भुगतान कर दिया है, तो पार्ट-ए में 15% ब्याज पार्ट-ए की किश्त भरने की अंतिम तारीख तक लगाया जाएगा।
• यदि किसी आवंटी ने पार्ट-ए की किश्त देने की अंतिम तिथि के बाद भुगतान किया है, लेकिन पार्ट-बी में अतिरिक्त कीमत की मांग के इशू होने से पहले भुगतान किया है, तो भुगतान की तारीख तक पार्ट-ए में ब्याज 15% लिया जाएगा। आवंटी द्वारा अंतिम भुगतान की तारीख के बाद, स्कीम के लॉन्च की तारीख तक बकाया मूल राशि पर ब्याज 12% लगाया जाएगा।

पार्ट-बी:

यह योजना स्वैच्छिक और वैकल्पिक है, जो आवंटी के ऊपर निर्भर है। जहां योजना का लाभ आवंटियों द्वारा लिया गया है, वहीं यह योजना अतिरिक्त कीमत की मांग से संबंधित सभी विवादों, मुद्दों व मुकदमों का निपटारा करेगी। इस योजना का लाभ उठाने के इच्छुक आवंटियों को किसी भी कानून की अदालत में लंबित मुकदमे को अलग-अलग या किसी भी एसोसिएशन या सोसाइटी के माध्यम से वापस लेना होगा और वे भविष्य में अतिरिक्त कीमत की कैलकुलेशन का विवाद नहीं कर पाएंगे।

यदि कोई आवंटी योजना का लाभ नहीं उठाते है, तो उन्हें मूल मूल्य के अनुसार ब्याज / विलंबित ब्याज सहित संपूर्ण बकाया राशि का भुगतान करना होगा, जिसकी कैलकुलेशन डिमांड नोटिस के समय की गई थी।

योजना के लिए आवेदन करने के लिए, एक विशेष ऑनलाइन पोर्टल बनाया गया है जहाँ एलिजिबल लाभार्थियों की सूची उपलब्ध कराई गई है। योजना का लाभ उठाने के इच्छुक आवंटियों को अपने प्लॉट के बारे में आवश्यक जानकारी देकर खुद को पंजीकृत करना होगा। सफल पंजीकरण के बाद, एक कम्पेरेटिव रिपोर्ट उत्पन्न की जाएगी जो योजना के पहले और बाद की राशि के बारे में, ब्याज दरों आदि की विस्तृत कैलकुलेशन के साथ जानकारी प्रदान करेगी। भुगतान करने के लिए एक बटन प्रदर्शित किया जाएगा जहाँ से लाभार्थी भुगतान कर सकते हैं और उसी की रसीद भी निकाल सकते हैं।
